Assault and battery are two separate crimes that are frequently confused with one another or sometimes thought of as a single charge. In California, assault may be described as an attempt or threat of violence. Battery may be described as the unlawful use of force against another person, or even the unlawful touching of another person. Because an attempt and act of violence may be carried out together, assault and battery are frequently charged together.
